Who we are
NewYorkBusinessFile.com ("we", "us") is a private business filing preparation and compliance monitoring service. We are not a government agency and are not affiliated with, endorsed by, or acting on behalf of the State of New York or any of its departments. This page, at https://newyorkbusinessfile.com/privacy-policy, is our only privacy policy; no other policy applies to this website or our messaging program.
Information we collect
Information you provide. Contact name, business name, email address, telephone number, mailing and business addresses, officer information, filing details, notes you submit, and account credentials if you create an account.
Public record information. Business entity information published by the New York Department of State and other public sources, including entity name, DOS ID, entity type, formation date, county, filing history, and registered addresses.
Usage information. Pages viewed, referring pages, approximate location derived from IP address, device and browser type, and similar analytics data collected through Google Analytics and comparable tools. We never send your mobile phone number or your SMS consent record to analytics or advertising tools.
How we use information
- To prepare, review, and support the filings you request.
- To confirm filing status and monitor upcoming or past-due compliance dates.
- To communicate with you by email, telephone, and — only where you have given express written consent — SMS text message.
- To operate, secure, troubleshoot, and improve the service.
- To comply with legal obligations and enforce our Terms of Service.
SMS text message communications
We send SMS text messages only to individuals who have given express prior written consent by checking the unchecked consent box on our filing preparation form at https://newyorkbusinessfile.com/prepare, or by another documented opt-in. Consent to receive text messages is never a condition of purchase or of using any part of this service, and we never purchase, rent, or import phone numbers into the messaging program.
What we collect for messaging and how we use it. When you opt in we collect your mobile phone number, your name, the business and filing the order relates to, and a record of your consent (the exact wording shown to you, the date and time, and the page it was given on). We use that data for one purpose: to send you customer-care and transactional messages about your own filing — order and payment confirmations, status updates, requests for missing information, filing confirmations, and reminders about your upcoming or past-due Biennial Statement. We do not use it for marketing to you on behalf of anyone else.
Example message. "New York Business File: your Biennial Statement for POP BRANDS INC. has been submitted to the NY Department of State. Reply STOP to unsubscribe, HELP for help."
- Message frequency varies and is tied to your filing and compliance activity. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- You can cancel the SMS service at any time. Just text "STOP" to the number from which you received messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

- We retain a record of your consent, including the exact wording shown to you and the date and time you agreed.
- No mobile opt-in or text message consent will be shared with third parties or affiliates for marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Data retention and security
We retain filing and consent records for as long as needed to provide the service and to meet legal, tax, and recordkeeping obligations. We use industry-standard administrative and technical safeguards, including encryption in transit and access controls. No method of transmission or storage is completely secure.
Your choices and rights
- Opt out of text messages at any time by replying STOP.
- Unsubscribe from marketing email using the link in any message.
- Request access to, correction of, or deletion of the personal information we hold about you, subject to our legal obligations.
Children
This service is intended for business use by adults. We do not knowingly collect information from children under 13.
Changes to this policy
We may update this policy from time to time. Material changes will be reflected by a new effective date at the top of this page.
